Nevada pedestrian accident claims: what you should know

Pedestrians have no protection in a crash, so even a low-speed impact can cause serious injuries. Pedestrian deaths are a serious problem in Southern Nevada, where wide, fast roads make crossing dangerous.

Drivers' duties to pedestrians

Nevada law requires drivers to yield to pedestrians in crosswalks (NRS 484B.283) and to use care to avoid hitting anyone on the road. Drivers who are speeding, distracted, turning without looking or ignoring signals can be held responsible.

What if I wasn't in a crosswalk?

You may still have a claim. Nevada uses modified comparative negligence (NRS 41.141). You can still recover money if you were partly at fault, as long as you weren't more at fault than the other side. Your recovery is reduced by your share of fault. Insurance adjusters know this rule well, which is why they look for ways to put blame on you.

Whose insurance pays?

Usually the driver's liability insurance. If the driver had little or no insurance, or drove off, your own auto policy's uninsured/underinsured motorist coverage may protect you even though you were walking. A household member's policy may also apply.

Common pedestrian injuries

  • Head and brain injuries
  • Broken legs, hips and pelvis
  • Spinal injuries
  • Knee and shoulder injuries
  • Cuts, road rash and scarring

Frequently asked questions

Can I recover if I was jaywalking?

Possibly. Nevada's comparative negligence rule may reduce your recovery by your share of fault, but you can still recover as long as you weren't more at fault than the driver.

The driver left the scene. What can I do?

Report it to police right away. Your own uninsured motorist coverage may help, even though you were on foot.

Does my car insurance cover me as a pedestrian?

Often, yes. Your uninsured/underinsured motorist and medical payments coverage may apply. More Money Morales can review your policy.

How long do I have to file a pedestrian accident claim in Nevada?

Nevada generally gives you two years from the date of the injury to file a personal injury lawsuit (NRS 11.190). Property damage claims generally have three years. Some claims, like those against government agencies, have extra rules, so it's best not to wait.

How much does it cost to hire More Money Morales?

Nothing upfront. There's no attorney's fee and no case costs unless we recover money for you.
