Nevada truck accident claims: what you should know

A crash with a semi, delivery truck or other commercial vehicle is different from a typical car accident. The truck is bigger, the injuries are usually worse, and there are often several companies and insurers involved, each trying to point at someone else.

Who can be responsible

  • The truck driver
  • The trucking company or employer
  • The company that loaded or secured the cargo
  • The owner of the truck or trailer, if different
  • A maintenance company or parts manufacturer

Interstate trucking companies must carry much more insurance than ordinary drivers. Federal rules generally require at least $750,000 in coverage for trucks hauling general freight, and more for hazardous materials.

Evidence that matters in truck cases

Commercial drivers must follow federal hours-of-service rules, and most trucks record driving time electronically. Truck data, driver logs, maintenance records, drug and alcohol test results, and dispatch records can show fatigue, speeding or poor maintenance. Some of this evidence can be lost if no one asks for it to be preserved, so More Money Morales moves quickly to protect it.

Nevada uses modified comparative negligence (NRS 41.141). You can still recover money if you were partly at fault, as long as you weren't more at fault than the other side. Your recovery is reduced by your share of fault. Insurance adjusters know this rule well, which is why they look for ways to put blame on you.

Common truck accident injuries

  • Traumatic brain injuries
  • Spinal cord injuries
  • Multiple broken bones
  • Internal injuries
  • Severe back and neck injuries

Frequently asked questions

Is a truck accident claim different from a car accident claim?

Yes. More parties can be responsible, there is usually more insurance, and federal trucking rules can help prove fault. The trucking company's insurer will often start its own investigation right away.

How long do I have to file a truck accident claim in Nevada?

Nevada generally gives you two years from the date of the injury to file a personal injury lawsuit (NRS 11.190). Property damage claims generally have three years. Some claims, like those against government agencies, have extra rules, so it's best not to wait.

Should I talk to the trucking company's insurance adjuster?

It's best to talk to a lawyer first. Don't give a recorded statement or sign anything until you understand your rights.

What if the truck driver says I caused the crash?

Fault is decided by the evidence, not the driver's story. Truck data, video, witnesses and the scene can show what really happened. Under Nevada law you can still recover if you were partly at fault, as long as you weren't more at fault than the other side.

How much does it cost to hire More Money Morales?

Nothing upfront. There's no attorney's fee and no case costs unless we recover money for you.
